WEBSITE TERMS AND CONDITIONS OF USE

Interpretation

In these Terms, the following expressions shall have the meanings set out below:

“The Terms” means these Terms as set out below, as amended from time to time as required.

“The Party” means the “Bennett 2026” party.

“The Website” means this website, located at be-yahad.org.il, or any other hosting site to which the Party may redirect.

“Terms of Use” means the terms in accordance with the provisions of these Terms and the provisions of any applicable law.

General

These Terms constitute the binding document that governs, regulates and sets out in detail the conditions for browsing and using the Website.

The Website management shall be entitled to change or update these Terms from time to time at its sole discretion and without prior notice.

Any use of the masculine form is for convenience only, and it is understood that the reference is also to the feminine, and vice versa.

The Website

The Party is the sole owner of the content appearing on the Website.

This website is owned and managed by the Party. The Website is intended to present the Party’s activities, objectives and goals, and it enables the collection of donations for the Party and registration of membership. Any use of the Website by a visitor, including the making of donations and registration of membership, constitutes the user’s consent to act in accordance with and subject to these Terms. The Website also serves as a platform for online communication and the transmission of messages on behalf of the Party.

The rights to use the Website address are reserved to the Party.

Use of the Website

The Website is intended both for the use of the Party’s members and supporters and for the general public.

Some of the applications and/or services provided on the Website will be available to Party members only, including the writing of comments in forums, the uploading of content for publication on the Website, and more.

Registration on the Website

For active use of the Website as stated above, registration will be required, in the course of which personal details and contact methods will be requested. In addition, part of the active use of the Website, or all of it, will be available to Party members only.

It is hereby clarified that registration on the Website constitutes absolute and full consent to receive information, including advertising and marketing information, in accordance with any law.

It is hereby clarified that registration on the Website constitutes consent to being contacted by the Party for any purpose whatsoever, including research, questionnaires, surveys, and as stated herein.

Registration on the Website constitutes full consent to these Terms and to the browsing conditions set out herein.

Submission of Details

Please complete your personal details fully and accurately. Submitting false details on the pages of the Website, including the donation form or the membership registration form, or knowingly providing incorrect details, constitutes a criminal offense. A donor or visitor who commits such an offense is liable to legal, criminal and civil proceedings.

The Party shall bear no responsibility for any unlawful activity carried out by users of the Website or by any other party not within its sole control. The interpretation and enforcement of these Terms, and any action and/or dispute arising therefrom, shall be governed by the laws of the State of Israel. Any dispute or question in connection with these Terms shall be brought for determination before the competent judicial instance in the Tel Aviv district only.

Confidentiality of Registrants’ Details

The Party and/or the Website managers will not transfer the details of users registered on the Website to external parties unless required to do so pursuant to a cause established by law, or in one of the cases set out below:

1. Following a breach of a provision of these Terms and/or a breach of an express instruction of the Party.
2. Following use of the Website for the purpose of defaming any party and/or impersonation and/or breach of the duty of privacy and/or insulting a public servant, as well as any other use that contravenes a provision of the law.
3. A police order or court order directing the Party to provide information about a user.
4. An express decision by the Party’s institutions in the matter.
5. In the event that the Party’s website is integrated and/or merged with another website or party.
6. In the event of legal disputes between the user and the Party that come to be resolved before any third party.
7. By reason of activity of the Website that requires the transfer of users’ information in a secure manner.

Liability and Information

It is hereby clarified that every user or visitor of the Website is solely responsible for any publication and/or use and/or service that they use on the Website. Should any of the Website’s visitors and/or Party members publish on the Website and/or in a forum and/or in comments any publication that constitutes an offense against the laws of Israel, including but not limited to a violation of the laws of defamation, protection of privacy, protection of databases, publication of prohibited marketing material, or offensive publication, they are solely responsible as the publisher and/or writer and/or commenter. The Party shall not be responsible for publications by members and/or visitors who choose to publish on the Website and/or in forum comments and/or in comments to a publication, whether on the Party’s website or on social network sites linked by the Website.

The Party reserves the right and the ability to remove any content, at its sole discretion, that constitutes harm to the Party and/or its members and/or any of its managers and/or employees, and no user of the Website shall have, in any way, any claim and/or demand and/or lawsuit in this regard.

Information Security

The Website managers will act to maintain a high level of security over all personal information in their possession; however, it is clarified that the Website managers and/or the Party are not responsible for any information sent via the Website, nor are they responsible for any damage and/or breach should a malfunction occur in the field of information security as stated.

Website Content

The content of the Website, including anything expressed on the Website, whether created by the Website managers and/or anyone on their behalf or by the users of the Website, including any expression in writing, form, sign, sound, image, video and the like (hereinafter: “the Website Content”), is intended for the enjoyment of the users and for the private and personal use of the users and the Party only. No commercial use, or any use that is not for private purposes (whether for profit or not for profit), may be made of the Website and/or of any of the Website Content and/or part thereof without obtaining the prior written approval of the Website managers.

One may not change, restore, redisplay, copy, transfer, duplicate, publish, broadcast, display in public, distribute, sell, grant a license to use, and/or make any similar or other use of the Website and/or the Website Content or any part thereof without obtaining the prior written approval of the Website managers.

Browsing and/or use of the Website is at the user’s sole responsibility. The Website managers and/or anyone on their behalf bear no responsibility whatsoever in connection with browsing and/or use of the Website and/or with respect to the content included on the Website by the users, including but not limited to tips, recommendations, comments, ratings, expressions, videos, audio clips, and the like uploaded by the users, as well as links and/or computer files attached to such content. The Website managers and/or anyone on their behalf take no position in connection with the content uploaded to the Website by the users and do not support and/or identify with any content included on the Website that is uploaded by the users. Any reliance on any of the Website Content is at the user’s sole responsibility.

All content included on the Website is presented to you AS IS. The Website managers and/or anyone on their behalf bear no responsibility for errors and/or inaccuracies in the content appearing on the Website. The Website managers and/or anyone on their behalf bear no responsibility whatsoever in connection with the infringement of copyright and/or any intellectual property rights and/or other rights of a third party as a result of the uploading of content to the Website by users. Any supervision of content that may be carried out by the Website managers at their discretion shall not impose any responsibility on the Website managers and/or anyone on their behalf for harm and/or damage and/or expense caused to the Website users and/or to any third party.

The Website may include, from time to time, links to other websites. The Website managers and/or anyone on their behalf do not undertake that all the links found on the Website from time to time will be functional and will lead to an active website. It is also hereby clarified that the Website managers and/or anyone on their behalf are not responsible and shall bear no responsibility in connection with the content appearing on these other websites or any consequence caused by the use of those websites. The fact that a particular link appears on the Website does not constitute a recommendation of that website or confirmation that the information on the linked websites is correct, up to date and/or lawful.

The user agrees that the Website managers are entitled to block their access to the Website or to applications or parts thereof and/or to restrict their use of the Website, without any need to notify and/or explain anything to the user, at their sole discretion. Likewise, the user agrees that the Website managers are entitled to remove, restrict or change any content uploaded to the Website by a user at their sole discretion and without any need to notify and/or explain anything to the user who uploaded the relevant content to the Website.

The user hereby agrees and confirms that they irrevocably waive any claim and/or demand and/or lawsuit and/or any other right against the Website managers and/or anyone on their behalf for any damage and/or harm and/or expense that may be caused to the user and/or to any third party as a result of use and/or browsing of the Website and/or exposure to its content, even if the Website managers or anyone on their behalf were aware of the possibility of their occurrence, and shall indemnify the Website managers and/or anyone on their behalf for any damage and/or expense and/or loss that may be caused to any of them as a result of a lawsuit and/or demand and/or claim by the user and/or by any third party in connection with the aforesaid.

The user declares and undertakes that any content the user uploads to the Website is not and will not be blatant, offensive, insulting, hostile, threatening, false, vulgar, violent, repulsive, unlawful and/or inappropriate content (hereinafter: “Prohibited Content”), and in particular, without derogating from the generality of the aforesaid: (1) content that includes or constitutes a threat, incitement, sedition, defamation, libel, slander and/or any racist or discriminatory expression; (2) content that constitutes a violation of censorship provisions and/or any other publication prohibited under any law; (3) content that includes covert or overt advertising, sales promotion and/or any other commercial information and/or the promotion of the interests of any organization or body, whether for profit or not; (4) content that includes the exposure of persons who are minors without their consent and the consent of their parents or guardians, and/or content that presents a minor in a degrading and/or exploitative and/or otherwise offensive manner, and/or any information and details regarding minors contrary to the provisions of the law; (5) vulgar/pornographic content that includes any expression and/or image and/or sound of a blatant sexual nature; (6) content that infringes and/or harms copyright and/or any intellectual property rights and/or other rights of a third party and/or breaches trade secrets or duties of trust of a third party; (7) offensive content that may in any way harm a third party, including harm to their feelings, their privacy and/or their intimacy, and including the disclosure of passwords, personal details and the like; (8) harassing, violent, repulsive and/or frightening content; (9) content that constitutes the transmission of “spam” or the mass sending of messages of any kind not at the request or wish of the recipients, including chain letters and/or pyramid schemes of various kinds; (10) content that includes material, or a reference to material, containing various types or a single type of virus, bug, Trojan horse and/or anything similar; (11) content that contains, or may contain, deception, including consumer deception; (12) content that may harm and/or cause damage to a person’s property, including their computer and/or computer files and/or software located on their computer; (13) unlawful content and/or content that contains unlawful messages and/or expressions and/or encourages the commission of unlawful acts and/or content containing links to unlawful websites or websites containing unlawful content and/or that provides information about, or refers to, unlawful activities and/or places and/or that constitutes grounds for any civil or criminal lawsuit; (14) content that constitutes prohibited file sharing.

The user undertakes not to disrupt and/or harm the Website and/or its operation and/or the services offered on it in any way, and in particular undertakes not to perform any of the following actions: (1) to upload to the Website harmful and/or offensive software and/or computer files or applications; (2) to make any technological changes to the Website and/or the Website Content and/or any information, application and/or other service available on the Website, including the security measures present on the Website; (3) to interfere with or change the source code of the Website and/or the source files of the Website and/or of the Website Content; (4) to impersonate another person or entity, to falsely claim affiliation with a person or entity, to forge a person’s electronic signature, to misrepresent the origin, identity or information transmitted through the Website, or to perform any similar fraudulent act; (5) to use the Website for unlawful purposes or purposes that violate laws, including but not limited to laws relating to copyright, intellectual property, data protection and privacy; (6) to defame, harass, abuse, threaten or deceive other users or third parties, to collect or attempt to collect personal details about users or third parties without their consent, or to use such details beyond what is permitted under these Terms of Use, it being understood that the details provided are for the purpose of personal acquaintance only.

The Website managers may be contacted via the “Contact Us” page regarding the reporting of errors or incorrect content; however, the Website managers will act at their discretion and do not undertake to act in accordance with your request. If you are aware of any possible harm to Website users and/or to any third parties, and/or of any action in connection with the use of the Website that constitutes, or is likely to constitute, any breach of the provisions of the law, you undertake to notify the Website managers thereof without delay.

Without derogating from any other right granted to them under the law or under these Terms of Use, the Website managers and/or anyone on their behalf reserve the right to sue a user who uploaded Prohibited Content to the Website and/or who otherwise breached the provisions of the Terms of Use. The user hereby undertakes to indemnify the Website managers and/or anyone on their behalf for any damage and/or loss and/or expense and/or anything else caused to any of them by reason of a claim and/or demand by any third party in connection with Prohibited Content uploaded by the user to the Website and/or any other breach of the provisions of the Terms of Use.

Intellectual Property Rights

The user confirms and agrees that the copyright and intellectual property rights in the content and in the variety of content products on the Website that were uploaded by the Website managers are the exclusive property of the Party and/or the Website managers and/or of third parties who granted the Website managers and/or anyone on their behalf a right to use such content, and in particular, without derogating from the generality of the aforesaid, the Website managers are the sole owners and/or holders of the rights to use the patents, designs, names and trademarks of the Website, whether registered or unregistered, the trade secrets involved in operating the Website and in providing the services on it, including all information included in the services provided on the Website, the design of the Website, and the technological information involved in its operation, including but not limited to texts, files, various applications, graphics, images, audio clips, music, video clips, characters, scripts, software and/or any other material included on the Website.

The copyright and intellectual property rights in the Website Content uploaded by the users, including but not limited to content products such as music, images, software, graphics, written and/or other information, belong to the users who uploaded them to the Website. At the same time, by the very act of uploading any content to the Website, the user grants, free of charge, to the Website managers and/or anyone on their behalf and/or to other bodies with which the company is connected in collaborations relating to internet content (the “Licensees”), irrevocably and for an unlimited period, a full and unlimited (non-exclusive) license to use such content (the “Use License”), that is, grants them the right to deal with the content without restriction. The Use License includes the right to perform any action that the Licensees see fit to perform on such content and/or any part thereof, including but not limited to its publication, copying, distribution, marketing, processing, abridgement, rewriting, restoration, broadcasting in any communications medium, translation into various languages, printing, editing, and the making of any commercial use of it for the purposes of the Website, as well as the right to grant a sublicense in such rights to any third party that the Licensees see fit. Notwithstanding the aforesaid, the Use License does not include the right to generate profits.

By the very act of uploading any content to the Website, the user hereby releases the Website managers and/or anyone on their behalf from any responsibility in connection with loss and/or harm and/or damage caused to such content. In addition, the user is entitled and undertakes to upload to the Website only content that is original to the user and/or content with respect to which the user holds the rights of use and/or the appropriate permits, authorizations and/or licenses that grant them the right to upload such content to the Website.

It is clarified that if, in the publication of any content on the Website, credit that should have been given under the Terms of Use was not given and/or incorrect credit was given, the sole and exclusive remedy against the Website managers and/or anyone on their behalf shall be the provision of the correct credit by the Website managers and/or anyone on their behalf with respect to the relevant content, as from the date on which all the data required to examine the matter were brought before the Website managers.
